Title IX of the Education Amendments Act of 1972

Provides:

No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.  Title IX is published in the United States Code at 20 U.S.C. §1681-§1688

Title IX of the Education Amendments Act of 1972 encompasses various areas, including but not limited to:

  • Education Programs or Activities: This pertains to any program or activity operated by an educational institution or entity that receives federal financial assistance.

  • Access to Facilities: Title IX ensures equal access to educational facilities and resources regardless of sex.

  • Discrimination: Title IX prohibits discrimination on the basis of sex, including acts that deny or limit an individual's ability to participate in or receive benefits from an education program or activity.

  • Athletics: It addresses equality in athletic opportunities, ensuring educational institutions provide equal opportunities for both male and female students to participate in athletics.

  • Harassment: It prohibits sexual harassment, which includes unwelcome sexual advances and other verbal, nonverbal, or physical conduct of a sexual nature.

  • Employment: Title IX prohibits sex discrimination in employment practices within educational institutions, including hiring, promotion, and compensation.

  • Retaliation: Title IX prohibits retaliation against individuals who file complaints or participate in investigations related to sex discrimination.
